Information Note on the Processing of Personal Data

 

Welcome to the information note on the processing of personal data of the site https://www.ikanos.ro (hereinafter referred to as "the Site" or "Platform").

 

Through this document we will provide you with information about what types of

we use and process data, for what purposes we process it, for what period of time we will store it, who has access to your personal data and other such information.

IKANOS processes your personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (hereinafter “RGPD”;), as well as other applicable legal provisions regarding the processing of personal data. personal.

To better understand our data protection policy, please read this information note carefully.

We reserve the right to periodically update and amend this Information Note on the processing of personal data ("Information Note") without your prior consent and without being subject to an individual notification procedure for changes.

In the event of any such changes, we will display the updated version of the Information Note on the site, and it is up to you to verify the contents of this  Information Notes whenever you visit the site, to make sure you are up to date with the latest version. 

We will treat your Data in a manner compatible with the Information Note on the basis of which it was collected, unless we have your consent to treat it differently.

IKANOS  processes your personal data in its capacity as Personal Data Operator.

What is personal data?

According to the RGPD, personal data means any information about an identified or identifiable natural person. An identifiable natural person is a person who can be identified, directly or indirectly, in particular by reference to an identification element, such as a name, an identification number, location data, an online identifier or one or more specific elements of his physical, physiological, genetic, mental, economic, cultural or social identity.

There is no list of personal data, and the RGPD does not require states to make such a list, for the simple reason that information may in one context become personal data and in another context be simply a information without value of personal data.

The principles followed by IKANOS for the protection of users of the Site with regard to the processing of personal data are the following:

a. Personal data are collected only for specified, explicit and legitimate purposes and are not processed in a manner incompatible with those purposes,

b. Personal data must be adequate, relevant and not excessive in relation to the purpose for which they are collected and / or further processed,

c. Personal data must be accurate and, if necessary, kept up to date; all reasonable steps must be taken to delete or rectify inaccurate, incomplete data, having regard to the purposes for which they were collected or for which they are further processed,

d. Personal data shall not be kept longer than is necessary for the purposes for which they were collected or for which they are further processed,

e. Personal data will be processed in secure conditions, thus ensuring a level of protection against illegal or unauthorized access, as well as against their loss, destruction, damage. 

Personal data processed by IKANOS as a Data Operator

Categories of data processed by  to IKANOS may be, depending on the purposes associated with the processing, one or more of the following:

Category Data included

Identification data name, surname, username or a similar identifier.

Contact details email address, phone number. Financial data information on payments or on the card / bank account, information on purchases.

However, to the extent that you have chosen to access and use the platform managed by our company or otherwise benefit from our services, the provision of personal data is a necessity in terms of legal requirements and / or legal relationship with IKANOS because this information are necessary for the provision of the services, and in the absence of IKANOS having this data we will not be able to offer some / all of our services.

Thus, in certain situations, depending on the data you refuse to provide, it is possible that:

IKANOS to be unable to conclude the legal relationship / contract or to continue the contractual relationship with you;

IKANOS to be unable to meet its obligations to you.

Where does your data come from?

We collect data from you when:

What types of data processing does IKANOS perform?

IKANOS processes personal data for the purposes set out in this information note, and one or more data processing operations such as collection, registration, organization, structuring, storage, adaptation or modification, extraction may be used for each purpose. consultation, use, disclosure

by transmission, dissemination or otherwise making available, aligning or combining, restricting, deleting or destroying. 

The purposes for which IKANOS processes your personal data

IKANOS processes personal data for multiple purposes, and the methods of collection, legal basis for processing, use, disclosure, retention periods, etc. may be different depending on each purpose. 

IKANOS may use your personal data for one or more of the purposes described in this Information Note.

If IKANOS  will subsequently process personal data for a purpose other than that for which you have already been informed and which is not compatible with the purposes for which the data were originally collected, IKANOS  undertakes to provide you with information on that secondary purpose as well as other relevant additional details.

We process personal data mainly for the following purposes:

Registering as a user of the Site;

Concluding and executing the contract of sale or provision of services that you conclude with IKANOS;

In order to give you access to materials available on the Site;

To manage the relationship we have with you;

Requests or requests made by you through the Site;

Legal bases on which IKANOS is based  in the processing of your data

The processing of data shall be based on at least one of the following conditions for the lawfulness of the processing:

the processing is necessary for concluding the legal relationship / contract with you or for its execution;

the processing is for the fulfillment of a legal obligation incumbent on IKANOS (eg those relating to the management of tax supporting documents);

processing is necessary for the purpose of the legitimate interests pursued by IKANOS, such as:

- managing our activity;

- managing the risks related to our activity;

- managing our relationships with potential customers, clients and / or partners;

the processing is based on your consent for cases in which the RGPD requires obtaining consent or it is not based on another condition of legality.

How long did we keep your data?

We retain your data processed by IKANOS only for as long as is necessary for the purpose for which they were collected (including in accordance with applicable law or regulations), as follows: 

for the period provided by law in situations where there are normative acts applicable in this respect (eg in the case of mandatory accounting records);

during the development of the contract / legal report for the processing of your Data necessary in its execution;

until the expiry of the limitation period, in cases where IKANOS would have a legitimate interest in keeping certain of your Data in connection with a potential dispute that may arise between the parties.

during the management of the relationship with potential customers / clients (for example during the existence of an active account on the Site, in the case of customers who created an account), for processing for the purpose of transmitting communications containing information

and offers regarding our services, as well as those of our partners, commercial communications, respectively until the exercise of the right of opposition (opt-out) by you in this respect; until the withdrawal of consent for the processing of your data based solely on consent;

In any other case or in the absence of specific legal, regulatory or contractual requirements, our reference period for the retention of personal data is a maximum of 3 years from the date of termination of relations / last contact between IKANOS and you.

Third party links

This Information Note does not cover other third-party applications and sites that you may access by accessing links on our site (including when you visit, for example, the pages of our social media communities, such as Facebook, Instagram, etc.). At the same time, we are not responsible for any links of our business partners or those who place advertising in our articles, including those on social media profiles. When you click on those links, third parties may collect or share data about you. We do not control the websites of these third parties, nor are we responsible for their processing, privacy and security policies. When you leave our site, we encourage you to review the Privacy Policy / Information Note, as well as the terms of Disclosure of Your Data to third parties. 

We may disclose your data in compliance with applicable law to business partners or other third parties.

For example, we may provide your data to other companies, such as IT or telecommunications service providers, media agencies, advertising agencies, accounting and human resources services, integrated solution providers, legal services, and other third parties with whom we have a contractual relationship. . These third parties are selected with special care so that your data is processed only for the purposes we indicate.

We may also share your data with other business partners as a result of a joint effort to provide a product or service.

Although unlikely, we may sell the business or part of the business in the future, which will include the transfer of your data.

We may transmit the data to other parties with your consent or according to your instructions.

We will also be able to provide your personal information to the prosecutor's office, the police, the courts and other competent state bodies, based on and within the limits of legal provisions and as a result of express requests. 

We will ensure, within reasonable limits, that your data does not leave the European Economic Area, but to the extent that we transfer data to non-EEA countries, we will ensure, in all cases, that the transfers are legitimate, based on your consent. explicit or other legal basis.

Other people's access to your personal data

In some cases, other third parties will have access to personal data, such as:

International transfers

At this time we do not transfer or intend to transfer your personal data or any part of it to other companies, organizations or persons in third countries or to international organizations.

If we need to transfer your data to any of the above destinations, we will send you a new information note in advance.

The transfer of personal data to a third country may take place only if the State to which the transfer is intended provides an adequate level of protection.

The transfer of data to a State whose legislation does not provide a level of protection at least equal to that provided by the General Data Protection Regulation is possible only if there are sufficient guarantees regarding the protection of the fundamental rights of data subjects. These guarantees will be established by us through contracts concluded with the providers / service providers to whom the transfer of your personal data will be made.

Some of our service providers may be located outside the European Economic Area (EEA), so the processing of your personal data by them will involve a transfer of data outside the EEA.

Each time we transfer your personal data outside the EEA, we will ensure that there is a similar level of protection.

Your rights and how you exercise them IKANOS is responsible for facilitating the exercise of any of your rights mentioned below.

The right of access

You have the right to access, according to Article 15 of the RGPD, respectively to obtain from IKANOS  a confirmation that it is processing or not processing personal data concerning you and, if so, the following information: (a) the purposes of the processing, (b) the categories of personal data concerned; (c) the recipients or categories of recipients to whom the personal data have been or are to be disclosed, in particular recipients from third countries or international organizations; (d) where possible, the period for which personal data are expected to be stored or, if this is not possible, the criteria used to establish this period; (e) the existence of the right to request the rectification or deletion of personal data or the restriction of the processing of personal data or the right to oppose the processing; (f) the right to lodge a complaint with a supervisory authority; (g) where personal data are not collected from the customer, any available information on their source; (h) the existence of an automated decision-making process including profiling, referred to in Article 22 (1) and (4) of the RGPD, as well as, at least in those cases, relevant information on the logic used and on the importance and expected consequences of a such processing for the data subject. If personal data are transferred to a third country or an international organization, you have the right to be informed of the appropriate safeguards under Article 46 of the Treaty.

At your request, IKANOS will provide you with a copy of your Data that is being processed.

The right to rectification of data 

You have the right to obtain from IKANOS the rectification of inaccurate personal data concerning you, in accordance with Article 16 of the RGPD. Depending on the purposes for which the data were processed, you have the right to obtain the completion of your Data which is incomplete, including by providing an additional statement.

When possible or necessary we will make corrections (as appropriate) based on updated information and inform you about this if necessary.

The right to delete data

You have the right to obtain from IKANOS the deletion of your Data (according to Article 17 of the RGPD), without undue delay, except for certain cases provided by the RGPD, if one of the following reasons applies:

a. Your data is no longer necessary for the purposes for which it was collected or processed;

b. withdraw the consent on the basis of which the processing takes place to the extent that the processing is based solely on consent and there is no other legal basis for the processing;

c. you object to the processing carried out for the purpose of a public interest or for the legitimate interests pursued by IKANOS and there are no legitimate reasons to prevail over your fundamental interests / rights and freedoms with respect to the processing or you oppose the processing for marketing purposes direct;

d. Your data has been processed illegally;

e. Your data must be deleted in order to comply with a legal obligation incumbent on IKANOS under Union or national law under which it is subject;

f. other situations provided by the RGPD insofar as they are applicable.

The right to restrict processing

You have the right to obtain a processing restriction in the following cases:

a. contest the accuracy of your data, for a period that allows IKANOS to verify the accuracy of the data;

b. the processing is illegal and you object to the deletion of your data, requesting in return the restriction of their use;

c. IKANOS no longer needs your Data for the purpose of processing, but you request it for the establishment, exercise or defense of a right in court; or

d. you objected to the processing in accordance with Article 21 (1) of the RGPD, for the period during which it is verified whether the legitimate rights of the controller prevail over those of the data subject.

The right to data portability

You have the right to receive your Data (according to Article 20 of the Regulation) that you have provided to IKANOS, in a structured, commonly used and automatically readable format, and to transmit it to another operator, without hindrance. from  IKANOS, if:

i. the processing is based on consent pursuant to Article 6 (1) (a) or Article 9 (2) (a) of the RGPD or a contract pursuant to Article 6 (1) (b) of the RGPD. RGPD; and

ii. the processing is performed by automatic means.

In the event of exercising the right to portability of personal data, they may be transmitted directly from IKANOS to another operator expressly indicated by you, where this is technically feasible.

Right to object when processing is carried out for the legitimate interests of IKANOS You have the right at any time to object, for reasons related to your particular situation, to processing carried out for the public interest or for the legitimate interests of IKANOS. In this case, IKANOS will no longer process your Data, unless it demonstrates that it has legitimate and compelling reasons justifying the processing and prevailing over your interests, rights and freedoms or that the purpose is to establish, exercise or defend a right in instance.

The right to object to processing for direct marketing purposes

When the processing is aimed at direct marketing, you have the right to object at any time to the processing of your data for this purpose, including the creation of profiles, insofar as it is related to that direct marketing. 

The right to withdraw consent

If the processing is based on your consent, you have the right to withdraw your consent at any time. Withdrawal of consent does not affect the lawfulness of the processing carried out on the basis of the consent before its withdrawal. The assumption of withdrawal of consent is not applicable in cases where the basis for processing is not consent 

The right to file a complaint or grievance
